Apple Inc. (AAPL) has filed a motion in a German court seeking to bar the German unit of Samsung Electronics Co. (005930.SE, SSNHY) from selling the Galaxy Tab 10.1N tablet in the European Union.
Apple has requested a preliminary injunction, and the Duesseldorf regional court has scheduled a hearing on the matter on Dec. 22, a spokesman for the court told Dow Jones Newswires on Tuesday.
The move has no effect on sales and distribution of the product, Samsung said in an emailed statement, while Apple repeated earlier comments that it intends to protect its intellectual property.
The court spokesman declined to say whether Apple has also sought a preliminary injunction against the South Korean parent company, but a person familiar with the matter told Dow Jones that the Cupertino, Calif., company has actually done so.
Apple scored a major victory against Samsung in September, when the same court banned sales of the Galaxy Tab 10.1 in the country after the U.S. firm accused Samsung of violating patents used in its iPad tablet.
Samsung said earlier this month it would release a modified version of its Galaxy tablet computer in Germany, called Galaxy Tab 10.1N.
Samsung and Apple have been waging a series of legal battles that began in April, when Apple sued Samsung in California, claiming the Korean firm's smartphones and tablets had "slavishly" copied the iPhone and iPad. Apple accuses Samsung of infringing some patents related to its designs and user interface, while Samsung alleges the U.S. company violated its telecommunications technology patents.
